Agreeing to these terms
These Terms of Use (“Terms”) are an agreement between you and TayoPo, based in Abu Dhabi, United Arab Emirates (“TayoPo”, “we”, “us”). They apply to the TayoPo apps for Android and iOS and the website tayopo.com (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Affiliate disclosure. If you do not agree, please do not use the Service.
Who can use TayoPo
- You must be at least 18 years old and able to enter into a binding agreement.
- You must not be barred from using the Service under the laws that apply to you, and you must not be on any government sanctions list.
- If you use TayoPo for a business, you confirm you are allowed to act for that business, and these Terms bind it too.
Your account
- You sign in with Google or Apple. Keep that account and your phone secure; you are responsible for what happens under your TayoPo account.
- Give accurate information and keep it up to date. One person, one account. Do not pretend to be someone else.
- Tell us straight away at info@tayopo.com if you think someone else has used your account.
- You can delete your account at any time in the app (Profile, then Delete account). See Delete your account.
What TayoPo is, and is not
TayoPo is an expense tracker and planning app. It is not a bank, wallet, payment, money transfer, remittance, lending, exchange, investment, savings, insurance, crypto, lottery, gambling or paluwagan service, or any other kind of financial service, and it never holds, sends, lends, exchanges or invests money. TayoPo helps you keep track of your own money, plan and save, find deals, and connect with other kabayans. To be clear:
- TayoPo is not a bank, wallet, payment, remittance or exchange service. It does not hold, send, receive, lend, exchange or invest money, and it does not connect to your bank, card or wallet.
- TayoPo is not a lender, credit provider, debt collector or credit bureau, and not an investment, savings, insurance or cryptocurrency service.
- TayoPo has no lottery, raffle, betting or gambling. The paluwagan draw only sets the order of turns; nobody pays to enter or wins extra money.
- TayoPo is not licensed or regulated as a financial institution by the Central Bank of the UAE or any other regulator, because it provides no financial services.
- TayoPo does not give financial, legal, tax, immigration or investment advice. Tips, insights and totals in the app are general information based on what you enter.
- Amounts, balances and peso values are only as accurate as what you enter. Exchange rates are the rates you set, not live market rates.
- TayoPo is not a party to any deal between users, or between you and a business or partner you find through the Service.
Money tools
Accounts, entries, budgets, Uwi Fund goals, utang and paluwagan in TayoPo are records you keep for yourself. These records are informal and not legally binding. An utang record or a paluwagan draw in the app is not a loan agreement, a guarantee or proof of payment, and TayoPo does not collect, hold or pay out money for any of them. Reminders you send through the app are sent by you, and you are responsible for being polite and lawful when you contact anyone. Any paluwagan you join or run is an arrangement between its members; make sure it is allowed where you live.
Sharing with a partner
If you invite a partner to your book, they can see it and, if you give them that access, add and change their own entries. Only invite someone you trust. You can remove a partner at any time; entries they already added stay in the book. If you join someone else’s book, that book belongs to them and they control who can see it.
Community
Bedspace, Preloved, Pasabuy and the Business directory let you post and find offers from other people. When you post or respond:
- You deal directly with the other person. TayoPo does not check every post, own the items or rooms, carry parcels, or hold payments, and is not responsible for any deal, payment, item, room or service.
- Bedspace: only list rooms you are allowed to rent out, and follow local tenancy and housing rules, including any limits on shared or partitioned housing.
- Pasabuy: only send or carry items that are legal to export and import, follow customs rules and baggage limits, and never carry a sealed parcel you have not checked yourself.
- Preloved: only sell items you own, describe them honestly, and do not sell anything listed under Content rules.
- Stay safe: meet in public places, inspect items and rooms before paying, never pay deposits to people you cannot verify, and never share your passport, ID, bank or card details through a post.
Content rules
TayoPo has zero tolerance for objectionable content and abusive users. You must not post or send anything that:
- Is illegal where you or the reader are, or helps someone break the law.
- Is a scam, fake listing, pyramid scheme, or a misleading price or description.
- Offers jobs, visas, work permits or recruitment, or money lending, exchange, investment or remittance services, without the licences the law requires.
- Offers drugs, prescription medicine, alcohol, tobacco or vapes where not allowed, weapons, counterfeit goods, stolen goods, or anything banned by customs.
- Is sexual, pornographic or offers adult services.
- Is hateful, threatening, bullying or harassing, or attacks anyone’s religion, nationality, race, gender or community.
- Insults a religion, a country, its leaders or its symbols, or breaks local laws on public morals.
- Shares someone else’s personal information or photos without their permission.
- Copies someone else’s content, brand or trademark without the right to do so.
- Is spam, repeated posts, or links to harmful websites or software.
We use automatic checks and human review to keep this content off TayoPo. We may remove any content and suspend or close any account that breaks these rules, without notice, and we may report illegal activity to the authorities.
Reporting and blocking
- Report any post or user from the post’s menu in the app, or email info@tayopo.com.
- You can block a user so you no longer see their posts and they cannot reach you through TayoPo.
- We review reports within 24 hours and remove content that breaks these Terms. Users who post it may be removed from TayoPo.
Your content
You own what you post. To run the Service, you give TayoPo a free, worldwide, non-exclusive licence to host, store, copy, resize, display and share your posts, listings and photos within the Service and in promoting it, for as long as they are on TayoPo. This licence ends when you delete the content or your account, except for copies others have already shared or that we must keep by law. You confirm you have the rights to everything you post and that it follows these Terms.
Business listings
- A business listing puts your business in the TayoPo Business directory for the plan period you buy.
- Your listing must describe a real, lawful business that you are allowed to represent, with the licences it needs.
- A Verified badge means we have checked basic details you gave us. It is not an endorsement or a guarantee of your goods or services.
- Plan benefits, such as placement above free posts and no ads on your page, are described in the app before you buy. Placement and reach are not guaranteed to produce any number of views, calls or sales.
- We may refuse, pause or remove a listing that breaks these Terms.
Payments, renewals and refunds
- How you pay. Business listing plans are sold as in-app subscriptions through Google Play or the Apple App Store, and paid with the payment method in your Google or Apple account. We do not take payments any other way.
- Plans and prices. Plans are 1 month, 6 months and 12 months. The price, billing period and any tax are shown in the app and by the store before you confirm. Prices may be shown in your local currency.
- Automatic renewal. Your plan renews automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends. Your store account is charged within 24 hours before renewal.
- Cancelling. Cancel anytime in Google Play (Payments and subscriptions) or in your Apple ID settings (Subscriptions). Your listing stays active until the end of the period you paid for. Deleting the app or your TayoPo account does not cancel a subscription.
- No refunds from TayoPo. A business listing is a digital service that starts as soon as your purchase is confirmed. By buying, you ask us to start it straight away, and TayoPo does not give refunds or credits for any purchase, unused time, partial periods, or listings removed for breaking these Terms.
- Store refunds. Google and Apple handle all payments, so any refund request must be made to them, and they decide it under their own refund policies. Nothing in these Terms takes away rights you have under consumer law that cannot be excluded.
- Price changes. If a plan price changes, the store will tell you in advance as its rules require, and you can cancel before the new price applies.
Ads and free features
TayoPo shows ads to stay free. Some features can be unlocked for free by choosing to watch a short ad, such as showing a poster’s contact number or publishing a post. Watching is always optional. Ads are provided by third parties; we do not endorse what they advertise.
Partner links and deals
Flights, tours and coupons in TayoPo come from travel and shopping partners. Prices and availability are provided by them, change often, and are only confirmed on the partner’s site. When you book or buy, your agreement is with that partner, and its terms, fees, refund and change rules apply. Coupon codes may expire or have conditions set by the shop. We may earn a commission when you book or buy through these links, at no extra cost to you. See our Affiliate disclosure.
Fair use of the Service
You must not:
- Copy, scrape or collect posts or users’ details by automated means, or use them for marketing.
- Reverse engineer, decompile or try to get the source code of the apps, except where the law allows it.
- Break or test our security, overload the Service, or get around limits, ads or payments.
- Use the Service to send spam, or for any purpose these Terms do not allow.
Our rights
The TayoPo name, logo, design, apps and content (other than users’ content) belong to TayoPo or its licensors. We give you a personal, non-transferable, non-exclusive, revocable licence to use the apps on devices you own or control, for your own use, under these Terms and the rules of the store you got them from. All other rights are reserved.
Changes and availability
We keep improving TayoPo, so features may change, be added or be removed. We try to keep the Service running smoothly but cannot promise it will always be available, error-free or that your data will never be lost. Records kept only on your phone can be lost if you lose, reset or change your phone.
Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we make no promises about it beyond those in these Terms, including about the accuracy of flight prices, deals, coupons, user posts or business listings, or that the Service will meet your needs.
Limits on our liability
To the extent the law allows, TayoPo is not liable for any indirect or consequential loss, lost profits, lost data, or for loss caused by other users, businesses, partners or ads, or by deals made through the Service. Our total liability to you for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and AED 100. Nothing in these Terms limits liability that cannot be limited by law, such as for fraud or wilful misconduct.
Your responsibility to us
If someone makes a claim against TayoPo because of your content, your deals with others, or your breach of these Terms or the law, you agree to cover the reasonable losses and costs that result, to the extent the law allows.
Ending your use
You can stop using TayoPo and delete your account at any time. We may suspend or close your account if you break these Terms, if the law requires it, or to protect users. If we close your account without a breach on your part, we will tell you where we can. Sections that by their nature should continue (such as payments, disclaimers, liability and law) continue after your use ends.
Apple and Google
If you got TayoPo from the Apple App Store:
- These Terms are between you and TayoPo only, not Apple. TayoPo, not Apple, is solely responsible for the app and its content.
- Your licence to use the app is limited to Apple-branded devices you own or control, as allowed by the App Store Terms of Service.
- Apple has no duty to provide maintenance or support for the app. Support is provided by TayoPo at info@tayopo.com.
- If the app fails to meet any warranty that applies, you may tell Apple, and Apple may refund the purchase price of the app (if any). To the extent the law allows, Apple has no other warranty duty for the app.
- TayoPo, not Apple, is responsible for any claims about the app, including product liability, failure to meet legal or regulatory requirements, consumer protection, privacy and data use claims.
- If anyone claims the app or your use of it infringes their intellectual property, TayoPo, not Apple, is responsible for dealing with that claim.
- You confirm you are not in a country under a U.S. Government embargo or listed as a “terrorist supporting” country, and are not on any U.S. Government list of prohibited or restricted parties.
- You must also follow the terms of any third-party service you use with the app, such as your mobile network.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you got TayoPo from Google Play, the Google Play Terms of Service also apply to your use of Google Play, and Google is not responsible for the app or these Terms.
Law and disputes
These Terms are governed by the laws of the Emirate of Abu Dhabi and the federal laws of the United Arab Emirates. If you have a problem, please contact us first and we will try to fix it. If we cannot, the courts of Abu Dhabi have jurisdiction, unless the law of your country gives you the right to bring a claim where you live.
General
- We may update these Terms. We will change the date at the top and, for important changes, tell you in the app before they take effect. If you keep using TayoPo after that, the new Terms apply.
- If any part of these Terms cannot be enforced, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer these Terms to anyone else. We may transfer them if TayoPo is merged or sold.
- These Terms, the Privacy Policy, What TayoPo is and the Affiliate disclosure are the whole agreement between you and TayoPo about the Service. If a translation differs, the English version applies.
